By becoming a member of P2PAFFINITY.COM or by logging on to our platform or by submitted any of our forms available online, you give us your express authorization to collect, store and share your personal data

according to the Terms and Conditions detailed below:

P2PAFFINITY.COM is committed to protecting the information that you provide to us and will hold in in strict confidence unless authorized to part with such information by Law and only upon request of a authorized authority according to the Laws of Jamaica. 

 

Our Customer Privacy Notice applies to all of your personal information held by P2PAFFINITY.COM as a Data Controller under the Data Protection Act 2020 (“the DPA”).

 

Our Customer Privacy Notice describes what information we collect about you, how we may use any such information provided by you, who we may share it with, under what circumstances  the information we collect about  you is shared and your rights relating to the collection, storage and dissemination (sharing) of any such information.

This notice further details what steps will be taken by us to ensure that your information is kept private and secure.  even after your agreement for our services ends.

 "You" or "Your", this means: –

  • You;

  • Any authorised person on your account;

  • Any one who stands in your shoe as your lawfully authorized agent or persoanl represtnative  such as your trustee(s), executor(s) or attorney(s) acting under a duly stamped and registered Power of Attorney; 

 

“We”, "Our" and "Us"  means P2PAFFINITY.COM  and its subsidiaries, assignees and/or successor(s), which acts as a data controller for your personal data.

 

What information we collect?

 

The information we collect is primarily aimed at allowing us to offer our services to you. This information primarily relates to  your identity, income  and contact information. This information is provided by you directly when you complete our online "APPLY" form or when you complete the contract for your loan and is only shared with the third party who has accepted your offer to be their borrower.

 

That information may include the following: –

  • Your personal details (For example, your name, date of birth, and other identification information.)

  • Your contact details (For example, your address, phone number and email address.)

  • Information concerning your identity (for example, tax registration number, national ID card and copy of driver’s license.)

  • Proof of Income/Assets (such as payslips, bank statements and motor vehicle and property titles.)

  • Proof of Employment (job letter)

  • Character References (written or by telephone, email)

  • Other information that you provide us with by filling in forms or by communicating with us by using any communication medium whatsoever.

Any and all information that is uploaded to our systems in connection with the services we provide is collected, stored and shared by us in line with our Data Protection Policy.

What we use your information for, and the legal basis for doing so

We may use the information collected from you for a number of reasons, such as, to:

  • Provide, operate and maintain the services we offer to you.

  • Process, manage and complete transactions.

  • Send to you notifications and of outstanding payments to be made by you.

  • To send updates relating to the services being provided to you.

  • Manage your use of our services

  • Respond to your enquiries or comments

  • Provide you with customer service and support.

  • Investigate and prevent illegal activities.

  • To carry out credit checks.

  • Manage risk to ensure security and business continuity.

  • To satisfy debts owed to us

  • Provide to any entity authorized under the Laws of Jamaica to have access to your information such as an investigator body such as the Police, The Director of Public Prosecutions or our Attorneys-at-Law.

The Laws of Jamaica requires that we must have a legal basis to collect, store and process your personal data.

 

The legal basis is usually one or more of the following:

  • To allow us to have such information that is necessary for us to provide our service(s) such as to facilitate the creating of your customer account(s) and the processing of transactions); or/and

  • To allow us to meet our numerous legal obligations such as requiring proof of your identity and source of funds to facilitate and repay the loan(s) so that we may satisfy our anti-money laundering obligations; or/and

  • To protect and further our legitimate interests 

 

Compliance with laws and regulatory obligations:

 

We may use your information to meet our compliance obligations. By utilizing our platform and/or services, you accepts that we may be required to share your information with regulators and other government bodies that our organization, platoform and it's members are subject to. Yuor information will be shared in circumstances where such sharing is necessary in order to help detect or prevent crime (including terrorism financing, money laundering and other financial crimes).

Marketing:

We may use your information to provide details about our products and services via email, telephone, text, secure messages or social media.

 

You may opt out of receiving our marketing messages at any time. You may contact us to let us knwo if you no longer wish to receive our marketing messages.

 

Should you instruct us not to send you marketing communication, it may take a few days for us to update our systems and records to reflect your request and therefore you may continue to receive marketing messages during the period until your request takes effect on our system.

 

Please keep in mind that although you might have instructed us not to send you marketing messages, we may continue to use your contact details to send you important notifications subject to your agreement for our services or if we need to inform you of anything having  to do with comply with our regulatory obligations.

Sharing of your information:

We will keep your information confidential, but we may share it with third parties who also must keep it secure and confidential. in order to provide our service(s) to you. 

 

 Your information may be shared with the following persons:

  • Lenders on our network 

  • Providers of payment processing services and other businesses that may help us process your payments.

  • Government agencies such as the Tax Administration of Jamaica, Stamp Office, National Land Agency,

  • Non-governmental entities such as Real Estate Brokers that can help us realize any security given for a loan

  • Debt collectors or recovery agencies who may assist the lender with recovering sums owed and collateral due to default on a loan facility provided to you.

  • Regulatory Bodies such as the Bank of Jamaica, the Financial Service Commission or Financial Investigations Division,.

  • Auditors who examine and analyse our records for business purposes.

  • Investigatory Bodies such as JCF, FID, DPP

 

For how long we keep your information:

We will keep your personal data as long as you are our customer and will retain your information up to ten (10) years from when our relationship ends. This allows us to comply with legal and regulatory requirements or use it where we need to for our legitimate purposes, such as managing your account and dealing with any disputes or concerns that may arise.

 

We may need to keep your information longer where we need the information to comply with regulatory or legal requirements, help detect or prevent fraud and financial crime.

Your rights:

You have certain rights relating to your personal data which includes:

  1. Be informed about how your personal data is being processed.

  2. Request access to your personal data.

  3. Consent and withdraw consent.

  4. Request the correction or rectification of your personal data.
